Administrative Law Offenses
Administrative Law is created by state legislatures and encompasses procedures under which government agencies operate, as well as the external constraints upon them. Generally speaking, there are two types of administrative law:
- The first type includes rules and regulations. Rules and regulations are policies that dictate how a law is to be used. Congress and state legislatures enact laws, but they don’t usually specify how laws should be used. Our government uses special agencies in order to administer the law. These agencies use rules and regulations to determine how a law will be applied and enforced. These rules and regulations are a type of law.
- The second type of administrative law includes administrative decisions. Government agencies issue their own decisions regarding the application and enforcement of rules and regulations. A government agency has the power to conduct its own hearings and render its own opinions and orders. Rulings are made by administrative law judges. These decisions are also a type of law.
Committing an administrative offense is described as an unlawful culpable action or an omission to act, which violates rules that have been established by competent state agencies to protect the interests of the state, public organizations, citizens, public order, state and public security; and so forth.
An administrative offense differs from a crime by the lesser degree of social danger. The commission of an administrative offense serves as the grounds for applying social or administrative sanctions. Therefore, even though the criminal act behind it does not constitute a crime, the administrative offense is a criminal offense for all intents and purposes.
In cases where an administrative offense was committed, commuting the offense to penalty may prevent the indictment and may even be resolved without criminal records, provided the terms in the Administrative Offenses Law are fulfilled.
