Alcohol-Related Offenses in Oklahoma
Oklahoma implements “implied consent” law, which means that if you are pulled over, you agree to a breath, blood, or chemical test to determine if you are driving under the influence. If you refuse to take these tests, the police officer can seize your driver’s license and you will be summoned to appear in court for a hearing.
If you have any prior DUI or DWI arrests in Oklahoma and refuse to take these tests, the state can suspend your license for 6 months or up to 3 years.
Driving Under the Influence (DUI)
There are four ways a person can be charged with DUI:
- Driving under the influence of alcohol
- Driving under the influence of drugs
- Driving under the influence of a combination of alcohol and drugs
- Driving with a blood alcohol concentration (BAC) of .08 or higher
Driving While Intoxicated (DWI)
An individual may be charged with a DWI if he or she is found to be driving an automobile with a BAC level of .06 or .07. Many individuals are easily misled by this law, because even though the legal limit of a DUI conviction is a BAC of .08+, a person may still be criminally liable for driving with a BAC under that level.
Actual Physical Control (APC)
State law allows for the prosecution of individuals having “actual physical control” of a motor vehicle while his or her BAC is above the legal limit even though they are not driving (ex: parked in a public area). Despite the fact that circumstances surrounding an APC charge are usually different than those of a DUI or DWI, the liabilities are the same.
