In Oklahoma, the crime of robbery is defined as: a wrongful taking of personal property in the possession of another, from his person or immediate presence and against his will, accomplished by means of force or fear.
Moreover, the value of the stolen items does not matter. Even if a person were to take a pen or pencil from someone else, the crime of robbery would still have been committed if it was done using force or fear against the victim.
It is important to distinguish the crime of robbery from those of theft and burglary:
- Robbery: personal property belonging to another stolen using a method of force or fear
- Theft: personal property belonging to another stolen using a method of fraud or stealth (can occur with or without the victim’s knowledge)
- Burglary: personal property belonging to another stolen from the victim’s home
Due to the violent nature of the crime, robbery carries a range of serious punishments. Both first-degree and second-degree robbery are felony offenses. First-degree robbery carries a sentence of 10 years to life in prison, and second-degree robbery carries a sentence of up to (but not exceeding) 10 years in prison.
Additionally, robbery is an 85% crime, meaning that those found guilty are required to serve at least 85% of the sentence imposed at conviction before they are eligible for parole or earned credits that can reduce the length of time that remains in their sentence.
